Refund of capitation fee from college on special grounds

my brothers son got admitted in a deemed university for m.b.b.s during june 2016 and during october 2017 he and his classmate met with road accident in motor bike died on the spot. Is there any possibility to get partially or fully the capitation fee at this juncture.
A notice can be sent to the college for refund of fee paid. If the accident was confirmed by the government authorities then notice will be sent. Further steps can be prepared and proceed. The college is answerable
