POOR SERVICE AND CHEATING BY CIVIL CONTRACTOR

For construction of my house I entered into a contract with the contractor. The contract was to complete house. The payment consideration was fixed including material & labour. However, now after few months of construction, he is not completing the construction as per the contract and quality of the construction is not upto the mark. He has taken advance for material but he has not delivered the fully. Overall he has betryaed us and it is clear case of breach of the contract terms. Please advise
