Not recieved wedding video by photographer

Respected all,
I am not received wedding video from photographer from last 4.5 years
& I have done all the payment but he did not provide any receipt of this. all the communication was done on call & he's always give a date from last 4.5 years. For proof:- I have one photo of his in which he hold a video camera & make a video in my wedding & also I have call recording in which he give a date as usual.
I have also police complaints against him but response is getting.
Can i get my video legally?
you can file the case in consumer court as well as criminal case under section 406 and 407 of IPC. and can get video back from him if he is having that else you can get compensation and put him behind the bars.
