Not getting car mileage as claimed by the company what can I do

Dear sir i bought maruti swift Zxi last year june through car loans from SBI bank alandur branch.when i asked their delivery branch for quick delivery they said one car is ready for delivery eventhough i asked for other colour availability i purchased.they delivered in couple of days.i after that getting mileage of 12 kml thats too on the long journey from chennai to trichy.Thereafter in city i got mileage of 10kml due to this i changed 4 car drivers.till now i am getting mileage of 10 kml now they are not giving any proper answer's initiall y they assured in city i get 15kml in city

Hi,

Check whether you suit in the following criteria before we decide on filing a consumer complaint, thereby either claiming back the full sum of purchase with damages or exchange it with brand new vehicle.
1) You have not used your vehicle harshly, thereby putting the engine to uneven and rough condition.
2) You have serviced it only through the authorized dealer as per serviceable schedule mentioned by the company and have reported the problem during service.
3) You have sent written communication either in e-mail or through written letter that was acknowledged by the company/Dealer.
4) You have purchased only the brand new vehicle and not the test driven vehicle.

If you satisfy the above criterion you may file a consumer complaint for supplying a defective product to you and can get a suitable order from the relevant consumer forum. There is also possibility of amicable settlement by the company replacing engine or entire vehicle.

Clear cut case for consumer forum, but before getting into that, you have to see the assurances are in writing, and if so on what conditions, make your self clear before venturing into civil tort. Now it has become order of the day for these car companies giving sky hopes and doing nothing.

Dear Consumer, Please read the catalogue very carefully as there will not be any written assurance/guarantee from the manufacturer/dealer. regarding the mileage. Further, they will say only if you drive in a particular way there are chances of getting a mileage of x to y kms. These are mechanical issues and can't term these it as deficiency in service. So in my humble opinion, the chance of succeeding against the dealer will be remote.

You can get the car serviced properly and then check the mileage after that.

First ascertain that if the low mileage is due to the manufacturing defect or for any other reason.

The assurance by the company about this aspect cannot be taken for granted, neither there can be a consumer case maintainable on this ground.
