You can appear before the court tell the court to keep it for mediation. You can also contact the bank directly for mediation. You can bring the calculation before the court and the case can be dismissed at an initial stage.

If you’ve paid all your EMIs on time, yet the bank transferred your loan to ARCIL, this action may be legally unjustified. Under the SARFAESI Act, 2002, a loan can only be transferred to an Asset Reconstruction Company if it has been classified as a Non-Performing Asset (NPA), which requires a default of more than 90 days. If your payments were regular, your account should not have been treated as an NPA. Moreover, you are entitled to a notice under Section 13(2) of the Act before any such demand or transfer, and you have the right to object and challenge this. As your advocate, I can examine your repayment history, check if the NPA declaration was wrongful, file objections with ARCIL, and if needed, approach the Debt Recovery Tribunal (DRT) or High Court to protect your rights. You have a strong legal case—connect with me today for immediate help and full representation.
