MG Comet Car Delivered with Manufacturing Defect from Day 1

18-Mar-2025 (In Consumer Court Law)
I bought an MG comet Dec 26 and on Dec 27 realized that car has a manufacturing defect. Contacted the dealership and informed about the same, the dealership informed that we will get it sorted during first service. Now my car is in service center for more than 1.5 month, neither dealership nor manufacture responding and updating on any status. We have even served them a legal notice, they don't seem to care. Neither they are returning the car not responding. What are my legal options here?

It would be highly advisable to seek recourse through the Consumer Courts in order to pursue compensation and damages for the inconvenience and losses incurred due to the defective car. This may include, but is not limited to, the replacement of the faulty vehicle, repair costs, and any additional expenses related to the matter. Consumer Courts are well-equipped to handle such disputes and ensure that your rights as a consumer are protected. If you need any further guidance or assistance in filing a complaint or navigating the legal process, please feel free to reach out. I am happy to assist you every step of the way.

Apparently, it seems that they want you to take a legal route. Without referring to your legal notice, you can initiate a consumer court case against the dealer and the company. Since the pecuniary jurisdiction falls into district consumer forum, you can initiate the legal proceedings before district forum.

It's advisable for you to first of all rather than going legally you should serve them a legal notice and in that notice you can write either stop all these harassment or face legal action which will be at your own risk. After that if they fails to give you a satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction.
