How a NRI can file Consumer court case against builder for not refunding the booking amount because they have not launched the tower even after 1 year?

Dear Sir

you can instruct a lawyer to do on your behalf . I have first jand experience in dealing with such matter and have successfully helped lot of clients as well. For further procedure you can contact any lawyer in India or my self.

In the present case, first send a notice to the builders and post a reply/non reply we can then file the case where the property was bought. The nearest consumer forum which shall have the jurisdiction we shall file there.

You should firstly appoint an Advocate for the assistance and preparing of document and then you should appoint a POA from India by doing other formalities on overseas and he can file a complaint in your behalf and will represent you for the same in the court.

NRI can file a case in Indian Court like any other resident Indian. However, being located in a distant place he will find it difficult to handle various formalities of the litigation. To handle the problem you have two options. You can either come to your Indian address and file a case through your counsel and thereafter he contests the matter on your behalf and since the communications are very easy these days he can keep you updated and take instructions from you periodically. Alternatively, you can give a General or Specific power of attorney to some one you trust.

An NRI can file a Consumer court case in India through a power of attorney which may be given to a relative or your lawyer or anyone else who may pursue it on your behalf. If the booking amount was received and the Buyer's agreement has not yet been signed even after a year then you do have a good case to claim refund of the money along with interest and compensation.
