Guidance to proceed against a service provider for fraud and non trans

I did avail the services of a movers and packers company to move my excess baggage from Chennai to Bhubaneswar, Odisha and was charged for 23kgs while my bag weighed only 17kgs. I paid the charged amount and was assured the delivery in 3 days. Now , its already been 7 days and I haven't received my baggage. Upon tracking with their courier partner they are asking for extra amount and the movers and packers company wont take my calls.

You have two options, the first one is to file an FIR with the nearest police station either in Chennai or Bhubaneswar. This will be the fastest way to get your luggage back. An FIR will serve your purpose as the agency would definitely get frightened by registration of an FIR. You can book them under various sections of criminal law. The second option for you is to file a consumer complaint before the consumer forum but this is a slow remedy. By approaching the consumer forum you can also get your luggage back as well as you can claim compensation from the service provider for your mental harrassment and physical harrassment. Do you have any proof of the weight variance? If you do then you can sue them for charging extra, professional misconduct and cheating under consumer protection act, also for the excessive delay caused to you , you can take similar action but first you will need to send them a legal notice as per the consumer protection act and rules and if they do not comply you can file a case in the district consumer forum.
