Questions Answered by Advocate Sahil Kumar Nair

Q: Construction in front my land by a person which is govt land

Our land is registered and no litigation issues are there.but as we not staying in that city so one person (belong to schedule caste)constructed a duplex house in front of our land entrance which made our land entry very very narrow and we may not able to get approval for our house construction as per Odisha govt rules.

Advocate Sahil Kumar Nair answered
You will have to file a civil suit for your easementary rights. As per law, anyone who is constructing a house or any structure has to maintain proper distance from the adjacent building for proper ingress and egress. Once you establish the said fact, court will order to demolish that illegal structure. Or the court will order to heavily compensate you for the loss occured to you. Q: False Dowry Case against me and my parents

My wife and I are living seperately from past 2 years. she has filed a dowry case against me and my parents. However my parents were not staying with us neither have any role in our seperation.

Advocate Sahil Kumar Nair answered
You and your parents will have to appear in the case and fight out the case. Usually by taking wrong advantage of law, wives file false cases in the names of husband and her in-laws. But, there is nothing to worry because you will not be arrested in this case unless you violate any terms and conditions. Further advice can be given after proper discussion of the case. Q: SAME LAND SOLD TO TWO OWNER IN DIFFERENT YEAR ,WHO IS THE ACTUAL OWNER

My father buy a land from a person in 1989 legally and have original sell deed, unfortunately due to some reason he cant transfer the land to his name but he took possession and used the land since 1989 . But the owner sold the same land to other one in 1994 without our knowledge , the second buyer convert the land to his name but don't have possession. What to do to cancel the 2nd sell dead and transfer the property to our name?

Advocate Sahil Kumar Nair answered
As per your query, the solution to your case is to file a civil suit in the court for declaration of your sale deed as valid and the subsequent second sale deed as void and illegal. Once you file a civil suit after a complete trial the court can hold that your father's sale deed is valid and the second sale deed is illegal. Alongwith this you can also file a petition for injunction to restrain further alienation of your property.

Advocate Sahil Kumar Nair answered
You can file a civil suit in the court where your property situates. You will have to file a suit for specific performance. Once you file a civil suit then the parties will be made defendants in the suit. By this method you can make them comply with the contract.

Q: There was a uncle of my friend who died recently .

There was a uncle of my friend who died recently and before his death he mentioned in his will that after his death my friend's father will be the legal and only owner of his house although they both don't have any blood relation. The uncle had his own blood related brothers and sister so can they take the benefit of that and acquire that property even if it was on the name of my friend's father in the will. The sister had tried to sell the property without the consultation of my friend's father.

Advocate Sahil Kumar Nair answered
Even if the uncle has his own brothers and sisters still they cannot claim any right upon then property which your friend's father has inherited by virtue of will. He is now the only and absolute owner of that property. Further, no other heirs of that uncle can claim any share from your friends father. As you have mentioned here that his sister is trying to sell the said property, the remedy available to your friends father is to file a civil suit to declare his right over the property alongwith injunction (to restrain her) from committing any such further acts.
