Fraud case against jukaso journeys who are refusing the refund amount

Hi...I purchased a holiday plan from jukaso journeys on 6.8.17.till date I have not received the things which were promised to me at the time of membership...they are denying this fact because it was a verbal communication and we have nothing in written....I thought to go on a holiday trip that was also denied...reason unavailability though they promised that for any domestic holiday we need to tell them 7 days prior..I felt cheated and requested to cancel my membership...now they saw they would only refund 60% as we have cancelled it on 11 Th day of our membership...pl. help

You can file a consumer complaint depending on your contract with them. It would be good if you can divulge your contract details in specific; to see if they have committed any breach according to terms of the contract.

Dear sir, An oral promise is also binding. Further, if they have defaulted in providing tye services as assured you can file a consumer complaint seeking full refund. However, i would advise to send a legal notice through a lawyer before this. Many times matters resolve and other party pays the refund on the legal notice since they don't want to go for case. In amy case you may get it touch with me for drafting and sending of the legal notice if required. Further you may send the detials of the holiday plan for my perusal and further advise if required.

We handled similar case which was for refund of Rs. 110000 but jukaso had to pay rs. 145000 including interst and litigation expense. They came and settled the case in our office. Kindly contact if need any assistance.

Firstly, it is a case of cheating as all the essential ingredient which attract the provisions of section 420 IPC are present. The intention to cheat you is apparent from the very inception. The transaction referred by you has caused wrongful gain to you and wrongful gain to the other side. Thus, making it a criminal offence. Secondly, for filing the case we would require certain documents/information like: (i) Membership Receipt; (ii) How was the payment made; Any communication on record with them.
