Facts hidden in the contract of club membership can I claim refund
03-May-2023 (In Consumer Court Law)
I have got membership of Club Group of hotels whose agreement says membership amount is not refundable. I booked one of the hotels which was confirmed earlier but later denied saying room is not available on given date. Second time, I was told that room is not available when the same was available to other travel site. I was told that they sold 25% of room to outsider which was not told to me at the time of availing membership and is not part of the contract. Again, they provide me blue membership which is not there in the contract. Can I claim refund of membership fees.
The refund can be claimed for the memberships as the terms of contract have been altered and they have put you in a situation where you are not allowed to use the membership even after paying the fee
However, taking a legal recourse will be very costly and almost ineffective
I would suggest that you get a good negotiator to talk on your behalf who can make the club understand of the legal consequences and hope that they provide you with better services and a compensation for the loss that you faced or return your membership
However to do the same the negotiator will have to have a perfect knowledge of the terms of your contract and the promises they made while selling you the membership
