Do the builder need to share the annual/monthly account

Hi, I have a flat in Kolkata for which I got occupancy certificate more than 2 years back. There is no pending construction work in the society. Builder had mentioned that they'll charge flat owners for society maintaince till handover is completed. However, they are charging huge amount for maintainance without providing any annual / monthly account. Also, they are delaying the handover of society maintainance due citing one reason or other. Please can someone provide following information? 1. As we are paying maintaince fee to builder, are they legally bound to share the annual / monthly account? 2. Are they bound to handover the society maintainance to owner's assocition? More overe, what all options buyers have here?

The builder should be readily taken to the consumer court or to any civil court. Please consult between yourself and construct a society or a association to look after the maintenance. Ask the builder through an Advocate to stop the maintenance process giving them a TAT and after that period don't give them any amount.
Please make a note that if you do not want to avail maintenance from the builder, they cannot force you and if you all approach the builder through your association, the builder is bound to do that.
