Builder not refunding money after cancellation of booking

I have booked a flat with one of the reputed builders in Bangalore. Due to some personal reasons, I had to cancel the booking in Jan 2017. It is 15 months but still the builder has not refunded my money. As per them, the booking form has a clause which says that the money will be refunded only after that flat is sold to someone else. I have already agreed to 2% deduction as per the clause. I have not signed any agreement but just a booking form. There is no attempt from builder side to sell my flat. Pls suggest what can I do against such unfair trade practice.
Engage a advocate and issue legal demand notice and after receipt of the notice the builder do not refund you the balance amount. You can thru the advocate file a consumer complaint and ask reliefs of refund of money with interest and compensation for mental stress given to you by builder. For further advise etc you can contact me personally. (consultancy chgs Rs 300/- only.)
Issue a legal notice before inishiating any legal proceedings. Wait for his reply for the legal notice if he fail to replay for your legal notice file a petition before concerned civil court for recovery of money .
You can file consumer complaint against the builder seeking refund of money with interest. Beige that issue a legal notice seeking refund the amount . Contact us to give proper solution to your case .
