Builder late possession charges

I bought flat on August 2014 but builder didn't given possession till Jan 2019. As per agreement builder estimated 3 years for construction. Also 6 month grace period after 3 years. Builder is 10 Month delay in proving possession. Now builder registered in rera and telling that they will not give late possession charges Because according to rera registration his project is on time. Am i eligible to get late possession charges and if he refused than should I take possession or file case in consumer forum

Dear Client,
The builder is bound by the agreement which is executed between him and you. They will be bound to pay the late delivery charges for the delayed possession of the flat.
In order to approach the Competent Court, you are required to send a legal notice to the concerned person. In case you need any other legal advise for the same, do feel free to contact.

you should send a legal notice to the builder and in case he does not respond then file a case in the state consumer redressal forum for a speedy remedy including compensation from him for delay.
