Booked my unit with buy-back offer but Builder denying buy-back

05-Nov-2023 (In Consumer Court Law)
I booked a unit through an real estate agency with Buy-back scheme in a project Gurugram in 2016 during pre-launch of the project but I did not receive any CPR/ Buy-back agreement after booking to sign. In 2019, I received SOA for my unit from builder CRM in which booking category was showing “C.P.R”. But at the time of possession SOA in demand was not showing booking Category. But at the time of possession, builder denied buy-back for my unit and said my unit is not under buy-back as I don’t have any executed CPR/buy-back agreement and advised me to retain the unit. I have email confirmation from real estate agency that my unit was booked under buy-back. I felt cheated on the name of buy-back. I am not sure what to do now, can someone please advise?

From the contents of your query it seems you have been cheated and deceived by the real estate agency in connivance with the builder. Have you ever written any emails to them for the execution of the buy back agreement. You should immediately file a police complaint through a lawyer

Under the present facts and circumstances, it is advisable to take the situation with utmost seriousness and initiate appropriate legal action against the perpetrators. Further and better particulars are needed for an effective opinion.
