Advocate failed to file consumer case what action can i take

02-Sep-2023 (In Consumer Court Law)
I submitted 3 consumer case bundles to advocate and paid fees in 2013 but he failed to file them. When I submitted another 2 cases with other advocate in 2015 then only I detected so that ex advocate failed to file them within limitation period. Since I concentrated with my first appeal case I failed to enquire further. I contacted him in person phone and sms but I was given false assurances so that above cases were filed and orders will be issued soon.My advocate sent reply by SMS so that he will return bundle alongwith fees but in vain. Can I file a consumer case for deficiency in service?

Any deficiency of service can be sued through the consumer forum even against an advocate. As there is a special provision for suing an erring advocate under The Advocates Act, you can work out your remedy through the state bar council .
