What is the applicability of Limitation Act?

My father had filed civil case regarding void sale deed in 1979 , the suit is still pending in honorable court. The said suit is dismissed in year 1988 and same suit is restored in 1998. After 10 year the suit is restored. In 2014 i have applied for the amendment of plaint. i want to ask that 1.Do i have to put an application for raising Question regarding permission of collector after 35 year from suit is filed in 1979 OR 2.Should i calculate i raised question after 25 years as the suit was dismissed from 1988 to 1998 = 10 year. please guide

As you stated in your query that you have constructed your shop over Government land and more than 34 years you have possession over such land. Government have decided to demolished your shop on the basis of construction over Government land. In such a condition you need to fight with government regarding bread and butter and take benefit of adverse possession. kindly clarify me about nature of land so that I can assist you better in the context of law. how did you obtained the land... any documents signed..if yes need to go through the same then only better advice can be made in regards.

indian courts are very strict over the issue of encroachment.. however if u have a concrete reason of belief that your shop should not be removed then file a representation in the office of CO.
In worst case scenario if an order of demolition is passed then challenge that order in High Court in writ petition.
