What is the 10 rs stamp paper validity ?

04-Jul-2024 (In Civil Law)
Dear Sir, I have signed an agreement on 10 rs stamp paper in Delhi, but I was unaware of its validity. I need to understand the 10 rs stamp paper validity for my agreement. If it is not valid, what is the remedy? Also, is 10 rs stamp paper valid for rent agreement?

A document written on Rs.10 stamp paper in Delhi is not automatically void but will be inadmissible and cannot be acted upon if the proper stamp duty exceeds Rs.10; the Indian Stamp Act requires instruments to be duly stamped and permits impounding until duty and penalty are paid (Sections 33, 35 and related provisions). [https://legislative.gov.in/sites/default/files/A1899-2.pdf]. The Supreme Court has held that non'stamping is a curable defect (an instrument is inadmissible until duty+penalty are paid) -see Hindustan Steel Ltd. v. Dilip Construction Co., (1969) 1 SCC 597. [https://www.courtkutchehry.com/Judgement/Search/t/270534-hindustan-steel-ltd-vs-ms] and the seven'judge Constitution Bench decision In Re: Interplay between Arbitration Agreements -(Curative Petition) (Dec. 13, 2023) (which confirmed that insufficient stamping renders an instrument inadmissible but not void and can be cured by paying duty/penalty). [https://www.latestlaws.com/latest-caselaw/2023/december/2023-latest-caselaw-922-sc]. Remedy: have the deficit stamp duty and prescribed penalty paid and the instrument endorsed/regularised by the Collector or under court direction (Sections 35/36/38/40 procedure in the Stamp Act). [https://legislative.gov.in/sites/default/files/A1899-2.pdf]. For rent agreements in Delhi a Rs.10 stamp is generally insufficient; Delhi uses e'stamping and small'tenancy/11'month agreements ordinarily attract a nominal duty (commonly cited as about Rs.50) whereas longer leases attract 2%'5% of annual/average rent as applicable, so use e'stamp of the correct value (SHCIL e'stamping) or pay the correct duty and register if tenancy exceeds 11 months. A Rs 10 stamp paper in India does not have an expiry date for its use in executing legal documents. It can be used at any time, even after months or years of purchase, as long as it hasn?t been previously used. The six-month timeframe often mentioned applies only to seeking a refund for unused stamp paper not to its legal validity. Stamp papers of Rs10 denomination are commonly used for affidavits, declarations, and small agreements, and remain legally acceptable unless there is a specific legal or procedural requirement stating otherwise.

First of all, any agreement is generally executed on a stamp paper of rupees fifty or more. An agreement on a ₹10 stamp paper is not valid for significant contracts like rent agreements. ₹10 stamp papers are mainly used for affidavits and declarations. However, the validity of the agreement does not solely depend on the stamp paper; it is determined by the tenure and conditions mentioned in the agreement. If no tenure is specified, the enforceability depends on the circumstances. You should consult a lawyer to assess the agreement. If required, an advocate can draft a fresh agreement. Avoid relying on document shops, as they only print standard formats without legal accuracy. Hope this clarifies your query. If not, feel free to contact us.

The 10 rs stamp paper value depends on the nature of the agreement. It is difficult to determine whether your agreement is enforceable without knowing its exact purpose. If it involves the transfer of property or any other transaction, please provide more details to get an accurate response. Kindly reach out for further clarification.

Dear Sir/Ma’am, please note that unless an agreement has been registered with the appropriate authority, the presence or absence of 10 rs stamp paper does not affect its validity. The agreement remains valid if it complies with the provisions of the Registration Act. However, for agreements requiring registration, such as rent agreements, the 10 rs stamp paper validity may not be sufficient. You should verify with a legal professional to ensure compliance.

There are two types of agreements:
  1. Notarized agreements on 10 rupee stamp paper, which have limited legal validity.
  2. Registered agreements, which have stronger legal standing.
In your case, if it is a simple agreement on 10 Rs stamp paper, it may not have full legal enforceability. Without proper registration, no legal action can be taken based solely on it. If you require legal protection, you may need to execute a new agreement on an appropriate stamp paper and get it registered.
