What are the rights of wife on deceased husband self acquired property

HI, Husband died suddenly, Husband brothers filed case of property partition , saying its a joint family property. But that property and bank account is in name of Husband , which is self acquired property. Wife and 2 daughters are being suffered and only source of income is the bank account and property owned by husband. How to appeal strong to get justice for wife and daughters? Right now its in MA type case, courst has ordered LCR. What could happen next? Let us know what we can do to get justice for wife and daughters? Thanks

iF you have already engaged an efficient advocate to defend your case it will be embarrassing if you pass on to him some opinions by advocates in this forum, for obvious reasons. If not you better engage a known property lawyer who assures to save your late husband`s property to you.

When the case is in appellate court you must have engaged a lawyer

A widow and her children are the legal heirs of the self earned property of her husband.
Please let me know the detailed order of the lower Court. Without the details of the case, i could not discuss on this regard.

As you informed that it is self acquired property of your husband. Then after his demise, the possession of the said property fall into the share of his legal successor that is wife and his children not to other.
here the question of appeal does not arise. Here, for time being you can file the bear injunction suit against his brothers who is trying to interfere with possession over the said property.


In your case you have informed that " Right now its in MA type case, court has ordered LCR " Please provide detail that who had filed the case and which case is running. Apart from, your have mentioned that it is MA. Please provide information in which IA the said MA is filed.

Then only answer can be given in detail. Regarding self acquired property answer is given as above.
