Whether my sister is having legal rights to claim his share
If the land is self acquired property of your father he can do anything with the land and you and your sister cannot ask for partition while he is alive. In case if intestate property the children have the equal right irrespective of their gender. In case of the ancestral property the girl children has also right to ask for partition. To answer properly, the date of marriage of your sister, nature of property and other details are necessary.
As per the provisions of hindu succession act. A female can ask her equal share as son provided that the property must be an ancestral property. Insofar as the self acquired property of a father, no one can ask claim during the lifetime of father. If the father died intestate the property should be partitioned among the heirs equally.
Every girl child is entitled to inherit the ancestral/ self-acquire property of her father as per Hindu law of succession. She has every right to get equal share as that of yours at the time of partition.
Yes of course, she has the right to get the share from your Father as per the law.your father has to give the share according to law.if your father doesn't want to split the property he can pay the share amount if there's no objection on the part of your sister.
