16-Nov-2023 (In Civil Law)
I have entered into an sale deed agreement in the year 2009,where time limits, non refunds of token money, cancellition of deed is mentioned. But the vendor file a suit against me after 3 years at 2012 at Kolkata, high court, the sell deed is unregistered, non refunds and is undivided un portioned. The other parties are not enter into the agreement. Can court give any relief to the vendor

Unregistered sale deed does not confer ownership but can be used for collateral purpose e.g. to protect and prove ownership and in case it is to be used as an evidence then one has to pay the stamp duty and get it registered after paying some extra penalty with the order of the Court. Now the question arises whether the Court will provide relief to the vendor depends upon the facts and circumstances and also discretion of the Honorable Court.
Thanks.

without perusal of the terms and conditions of the said Sale Agreement it is not possible to give legal advice requirement to contest the suit filed by that vendor. Moreover You have not detailed the nature of that suit.
