Succession Certificate required for transfer of vehicle ownership

My father passed away in Feb 2016. We are having two vehicles in his name (one four wheeler and one two wheeler). Now we want to sell both the vehicles. RTO office has suggested to arrange succession certificate. I want to know what is the procedure for this and against whose name it will be issued (My mother or me{son} )

Succession certificate can be achieved by the order of the court. We need to file an application as per the Indian Succession Act, 1925. And it will not be against any other legal heir. For any further legal assistance please feel free to contact

it will be issued in the names of all the legal heirs/successors of your father's estate. you will have to do publication in newspapers and proceed in court seeking succession certificate, you will be granted that certificate least someone from your family objects and succeeds. in my opinion, an affidavit on the legal heirs'/successors' part to the concerned RTO should be sufficient for transfer.

Yes you may apply for a succession certificate. the procedure is that you'll have to move a petition before the concerned district judge under relevant provisions of the law under HMA and then you'll be granted a succession certificate.

Succession certificate is granted by the Courts in India to the legal heirs of a person dying intestate. In order to obtain a succession certificate, a petition to the District Judge has to be filed within whose jurisdiction the deceased person ordinarily resided at the time of his death. The succession certificate will be issued in your name as well as in the name of your mother.
