Restraining order against a neighbor

I am being harassed by my neighbor who lives on the second floor of my house on rent. The second floor was sold to someone else 20 years back and the person staying on rent there is causing a lot of trouble. He keeps passing derogatory remarks. Keeps coming down t our house to fight and scream on trivial matters. I am under a lot of stress due to this. is there a way to obtain a restraining licence so we don't have to face him

I have perused the contents of your query and would advise you to file an intallah peshbandi application/ complaint under the relevant provisions of Indian Penal code. You may initiate with the legal notice simultaneously calling up the neighbor to restrain hinself from unlawful acts.

Hello I have perused your query . In this matter you have an option to file an FIR against the said person for defamation and creating nuisance and trespassing

You can also file a private complaint for criminal intimidation before the magistrate.

A restraining order can be obtained as well by virtue of filing a suit for injunction in a competent court of law

You must file an Fir against the person who lives on the second floor, in the name of your wife and you as co-complainant. If, after filing the Fir, your neighbour troubles you or your grievances are unheard, in that case you must file a complaint before the competent court/magistrate.
