Respondent is willfully not filing reply from more then one year.


10-Sep-2023 (In Civil Law)
We 10 Sr. citizens (age 67 to 89 yrs) filled a civil writ against Jaipur Dev. Authority, in May 2015 and notices have been served in July 2015. The Respondent is willfully not filling the reply till date, as one of their Officer will be in trouble. Pl advise under which Sec. closer of reply application may be submitted or JDA may be ordered by court to fill the reply for early disposal of writ.

In the next hearing of the case you may request the court to order the respondent to file the reply or if the respondent is not willing to file the reply then the court may close the reply. There is no provision to file application for closing the reply of the respondent.

when it is wilfull delay on behalf of respondent without any proper and appropriate reason you can go to even Hhon'ble High Court as article 21 of constitution envisage right to life and it has very long and extensive definition it imbibes in it right to live life with dignity and full of rights and speedy trial is causing relaxation to petitioner on other hand too slow speed of trial or response by a respondent is denying that right of a person which has been enshrined in constitution . so you can contact to your lawyer . you will certainly get relief.
