A criminal case for transporting of liquor FOR SALE IN RAJASTHAN is made out by excise section 19/34 and license is cancelled by district excise officer by section 34, who was not authorized to do so. this case was as per excise law for section 69 or in case of accused licensee than section 58. i appeal against this to excise commissioner he reject it.I filled writ petition to HC Jaipur S.B. and D.B. they directed for appeal to Raj. Tax Board. Tax Board dismiss the appeal. raised question of law is not answer by any one up to HC judges. even they can not send aggrieved to any other office.
when any case is made by any authority who is empowered to do so it is bounden duty of that office / authority to prove that whatever action he has taken is right and in case they fail to do so it is liable to b quashed . Hon'ble High Court has given direction to appear before TAX BOARD is in what context that can be commented after observing entire facts and records but yes, remedies are available with Hon'ble High Court only and after that to Hon'ble Supreme Court.
