New builder asking for extra money for BWSSB, BESCOM and GST (our cost was all inclusive before) 2. first builder is the Land owner and a he is a defaulter in many banks (with civil, criminal and forgery cases on him) - if in case we agree to go with new builder what all new documents do we have to collect, Old builder is again one of the director/partner with new builder. 3. Size of the project is 500+ flats (i.e. 5 Blocks, 100 flats each) and only A block is 50% completed , rest nothing started. 4. any other way that we can come out of the problem (we all are paying EMI's to banks) please help

Sir, Please look into the agreement between new builder and the old builder. Your new builder cannot seek extra amount from you. Moreover their personal agreement if any is not binding on you. In respect of the flat only the agreements, deed that have been executed is binding. In your question your are saying that your earlier builder is missing and in the last but thrid paragrapgh you are saying he become the one of the partner with new builder. 1. I hope you already paid the amount towards the BWSSB, BESCOM and GST. Therefore once again the question does not arise. 2. No need collect new document. Here you need to verify the present transfer deeds between the new builder and the old builder. 3. Please go through construction agreement between your owner and other person who is the party to the said agreement. You are concern to your portion only. If it was already built its ok. If not you can challenge the same before any court of law. Please contact any counsel to take legal action.

- as per your facts first builder is the owner of the property so now how has the new builder has taken over the project the agreement which has given him the power s required. - The terms and conditions of your agreement with your first builder holds good the new builder cannot amend the agreement terms. - for violating the agreement terms you can claim for compensation and terminate the agreement.
