Plaintiff filed T.s and demanded 12 anna of share of land from her mother defendent although he have in possession of 3katha of land what share of land he got and what share of land got by the other lady defendent according to Muslim law

Since details ate not clear I am of the opinion that in the present case the Plaintiff has no locus standdi , since he/she received his/her share .S.C.has ruled in E.AbwbakerVs Ten Chand that the estate of a deceased Muslim devolves on his heirs in specific shares at the moment of death.
