Property dispute of two storied house among three brothers

v r3 brother having two storied house named on mother passed away. I locked my area of possession and shifted with family to other place. Now the 2nd Bhabi n family causing trouble to us by every means, two times police called of no use. Without my permission she opened my possession area and tried to capture it but v reached called police. She reversed the situation as earlier but v made a complaint to police. Now she is doing daily mischief to elder Bhai family, by saying bad words, throwing dust at their place etc. Elder brother is 60 yrs of age n heart patient, Bhai is sugar patient. She threatened them to hold their son in rape case, putting watering in house walls silently etc. She possessed all open area outside my area. Two sisters r also supporting them. Plz advice me what can I do to solve the matter.

in your situation its better to file a strong criminal complaint as soon as possible.
secondly you should not loose the possession of the house as whoever is in possession is the 80% owner.
you should file a suit for partition and injuction. so then a stay can be taken from court for any third party intesti.e status quo.

In the present situation, you may proceed to call the police and file a case for Harassment through mischief, harassment through nuisance. You may also file a complaint with the executive magistrate who will pass appropriate orders and injunct our sister in law from harassing you.
You should be wise and install a CCTV Camera on the outside of your house to capture the acts of your sister-in-law and thereafter proceed with your complaint before Court.
