Procedure in case injunction case is being dragged unecessarily

09-Dec-2023 (In Civil Law)
Problem is their was a huge tree in kacha road along our plots wall which has started uprooting our wall and threaten our house. We cut down the tree after a long talk with claimants false ownership and in end village officer on his descretion ordered to cut it as it was threat to our house. While we were removing the cut down tree parts after few days the said claimant again created problems and got an injunction order from court to maintain the status quo of the place and claimed the road belongs to them and that no one else have the right to execute anything thier and others may use it for road only with thier will and kindness. This case is in court for a year and the claimants have not yet produced any proof to back thier claim. we have all the proofs showing its part of our plot and that it is been given out by the old owner. Now this cut down parts have started rooting again and also the place have been so thick with weeds and could harbour snakes etc. And is a threat to all.

It is not a right thing to make an opinion regarding a matter which is pending for consideration before a Court of Law.
1) Even then you can approach the High Court concerned, asking for a speedy disposal of the case showing your difficulties. The High Court will dispose your petition with a direction to dispose the matter with in a stipulated time.
2) You can also file proper application asking for a speedy disposal of the case showing your difficulties before the Court in which the case is pending.
3) You can use the provisions available in alternative dispute resolution systems in Adalaths / Mediation centres etc..

Admittedly, the matter is pending in the court. The only course is ti secure an appropriate order from the court. Your advocate is the best judge in the matter.....
