Police is not taking action on complaint against Buyer
12-Mar-2023 (In Civil Law)
We had a civil dispute. Now the buyer has Trespassed the property & using it. Police is not taking action on complaint neither registering FIR. Complaint to DSP already done. Please suggest what we can do. My parents are senior citizen. Property on their name.
your case rests on the title of the property which is in dispute. the builder cannot just trespass and use the property if it is in your name, irrespective of who has the possession. rest depends on the title of the case.

Query perused. I would advise you to file an application under section 156 (3) of the criminal procedure code for registration of the FIR against the concerned trespassers. In the alternative suit for mandatory injunction thereby restraining the defendants from using and interfering in the peaceful possession of the property can be filed. what kind of civil dispute do you have? Is your civil dispute pending in the court? is the FIR registered? Once these questions are known i can suggest further course of action. But you shall be able to get him out of your property if he is a trespasser
