Not registered under society act how to solve disputes

 Ours is a housing society, not registered under Society's Act. We also do not have an agreement among members or any type of constitution. In such a situation, many a dispute are arising which hindered the smooth progress of the society. My question is to solve these disputes which law should be cited. Can we follow the society's act? Is there any clear cut judicial verdict in this matter? Please help to solve the situation.

It appears from the issue stated by you that your problems are arising since you do not have any standing set of rules for smooth day to day common services management of the cluster of apparents.The present state of affairs shall continue to be unabated if existing legal provisions are availed of.
If your apartment is in West Bengal, get the entire cluster of apartments covered under the West Bengal Apartments ownership Act 1972 and amendments thereof.This Statute is completely addressing all the vexed issues being encountered by you.However,if your apartment is not located in West Bengal, there is similar Statute.in respect of every state.You can avail legal course of action accordingly.

MY OPINION THAT when you are in a housing society ,everybody should follow the such rules of Society Act as well as you should follow the such fixed addenda as well as other acts of municipality /other area rules,.

First of all you should make a Society under Society Registration procedure and after then you see all the dispute has been solve within a second. On the other hand, until you form Society, the dispute will solve amicably in between the members or by way of Mass complaint before the Competent Authority against the wrong doer/doers.
