My tenant is not paying any rent from last 4 years what can i do

My tenant is not paying any rent from last 4 years and not reasy to leave the house. I have lodged the FIR to the nearest police station but nothing happened Then I put a case on him 2 years ago ij delhi court but he is kot receiving the summons from the court, hence case is not giing ahead as per my lawyer. How can i get rid of this urgently. As i am leaving on rent due to this and i urgently need my house because of the marriage of my 2 daughters..

You can file the suit for eviction under the ground of non payment of rent and recovery of rent.If the summon is not received then you can get summon served by pasting at conspicuous place.Further if he does not appear then you court shall issue warrant against them.I think you are misrepresented by your advocate

First of all we have to see what kind of rent are you charging. if it is covered under drc or otherwise it would be out of the scope of DRC. If he is not receiving summons then you have a number of options before the Court to have the same delivered to him to enable his court appearance

1. to move the case ahead, you should go to the "ahlmad" of the court room, you case is going in, the court appoints a person from the court who goes to that address to hand over the notice and if then they dont receive it, actions are taken against them.
2. court appoints person from the courts to make them receive the notice so that they start appearing before the court.

If you are legally correct on the agreement you have with your tenant, then you can simply send them an eviction notice again, and pursue with the case , for wrongful possession and eviction.

since you have already filed the case getting the parties to the court is the main task to be done here.
so approach the court on the date or approach the ahlamd with Process fee form , he will help you s it legal and his duty to do the same.

Dear querist, first you have to filled a case of suit for eviction, if you have already filled the case and your tenant is not receiving the summon then you can service him through DASTI or publication as the court pass order after this if he is not comming in court then the court may passed the order of ex-party eviction order in favour of you.
