My step mother mentioned as nominee will we get any share father dead

My father expired suddenly,we are first wife daughters ,at my childhood my mother expired ,my father got married to another she is now step mother she is alive.my father insurance policies nominee mentioned as my step mother did we get any share as a legal heirs.is succession certificate is mandatory to get share in insurance even nominee is mentioned plz advise sir...

Nominee is not a legal heir and who is having succession rights they will claim insurance with help of court order and they will win. Insurance policy one option is there "Married Women Protection Act" can be linked to life insurance and once a life insurance is linked to Married Women Protection Act then it comes under the control of a trust and no creditor or nominee can get their hands on it. Generally the spouse links his life insurance to the Married Women Protection Act so that in the event of his death, his wife is financially secure.

Since your father married after the expiry of your mother, your step mother will also be a legal heir along with you.

NOMINEE does not mean that your step mother is entitled to all of your father's insurance monies. As a nominee, your step mother is only a trustee in the eyes of law and it is her duty to ensure that all of your father's monies (including properties, bank deposits, insurance claims etc) are equally distributed amongst your father's legal heirs( including your step mother).

So apply for a family member certificate in Mandal Revenue office and based on that you should get succession certificate in a district court.

In the mean while you should also write to insurance companies stating that you are a legal heir and hence you are entitled to a share of insurance monies along with your step mother.

as already nominee is mentioned so you need to consult with concerned department and show your all identity and ask them to divide share equivalent and they will help you but you need to prove your Identity to the concerned department with concerned clerk.
