Legal action against Panchayat administration

I would like to explore the possibility of filing a case against the inability of panchayat administration to keep our village clean. We are a well developed area in our panchayat but still sewage from all our village is dumped in our area and people around our area use one of the free land in our area as dumpyard. It is lots pollution and mosquitos here still no action from our panchayat to clean and regulate and no plans for waste management. Is it possible to sue the officials responsible for this?

You can file a Writ petition for direction against the local body for not taking necessary effective steps to handle the solid waste in your locality and consequently creating land pollution. As Solid waste management rules, 2016 covers the local bodies such as panchayat with in it, you can seek for such a direction. Arraying pollution control board as a party can also be sorted out. But, before proceeding with seeking a court direction you need to under go the preliminary stage of demanding the concern authorities to look into these issues. You must knock the doors of judiciary as a last resort for relief.

Certainly you can sue the officials by filing a writ against the panchayat and government bodies for not providing proper facility to throw the garbages Also the owner of the particular area where garbages are dumped can claim compensation and protect his area from being polluted.
