Illegal Encroachment of land by Municipality for Drainage

Through RTI, we found out that our neighbor's land was acquired for drainage and compensation was also paid to them, but while executing it, they put the drainage on my land without notice, as we were absent in the premises during their construction. We found that the Corporator, land acquisition department, Executive Engineer, Legal department, all conspired with my neighbors for some extra pecuniary gains plus the compensation amount also shared, to provide my neighbors, Road -access to their lands thru this drainage job, as they didn't have road access. How do I get any relief

This is something that has been done wish conspiracy of government officials. You have to first make a complaint and application to concerned departments, and if that does not work approach Court against all of them.

As found that the Corporator, land acquisition department, Executive Engineer, Legal department, all conspired with your neighbors for some extra pecuniary gains plus the compensation amount, illegally approach an advocate and cause on them a notice to address you grievance. On their failure, the course open for you to have redress for your loss only by the court of law. Before that collect necessary evidence by taking the advise of the advocate who practice on civil side. Good Luck.

Please contact any advocate near by and issue notice to the concerned authority with regard to their illegal encroachment of the land, without your permission.

Moreover, before doing the encroachment, they need to check the land and fix the boundaries and also inform the owners of the land with regard to the acquisition proceeding. Simple coming and immediately encroach of the land without his consent illegal.

You can approach high court by filing writ petition for their illegal activity or also approach civil court seeking demolish the construction made by the authority colluding with the authorities. contact with all necessary documents.
