Husband wants to take kid out of country without getting child custody
02-Dec-2023 (In Civil Law)
My husband has recently stated through his lawyer that divorce has hapd and no written or any information has got. And the main concern is, he has plan of taking our 2 yr old out of country. I have not given him child custody. But he himself is making all possible way to get such things done by fooling me. My question is, I have my kid's passport with me. I assume that he will give passport lost complaint in the police station and based on that makes new passport with his some talaaq thing which is no where valid as he is not showing up us any copies, nor responding. Can I go to same police station and state that my kid's passport is with me and not lost and give written application, so that him taking kid out of country as of now gets stopped in this way. Please guide
Yes you can do that before that consult an advocate for better suggestion and Advice and facts are not narrated properly ..... please let me know child is currently residing with whom and have u contested the divorce petition and also check has he filed a case for child custody
You can give such a complaint to police, also you can even write to the passport office similarly. Another way is to file an injunction suit in family Court against taking the child out of your custody.
Yes you may can suit on your Husband its case of exparty you may challenge it.first you have to approach you didn't got any notices.and you may file for maintainance case on him. If you not married.then you have to meet advocate without fail
