How to sale Father property after demised. Pls tell us the procedure

Recently my father has passed away. Their is flat under my dad name, in my family we are now 3 members and we want to sale this property. What is the procedure?

As you have mentioned that there are 3 members in the family, all of them may have equal share in the said flat. You can sell the flat by 3 of you entering in to agreement for sale with the buyer. But it may happen that You might have to take heirship certificate from court if the buyer or the bank from whom he is taking loan insists for it.

If your father had made someone as the Nominee before he died, then the flat would directly get transferred in his/her favor. If your father had made a Will before dying & had mentioned in it that the flat after his death would get transferred to whom, then accordingly the transfer will take place. If your Father had not made a Will & he would have died without making a Will. Then, the property i.e the Flat would get transferred in equal proportion to all the three family members which are surviving as Beneficiaries. In case, if the Will was made & Nomination was too made, then the last Will of the Deceased will take effect & according to that Will, the Property will get transferred.
