How to handle adverse possession of land
25-May-2023 (In Civil Law)
25 yrs ago a relative of us purchased a land. But he haven't paid full amount that's why previous owner kept the property papers. Then he went somewhere and never came back and didn't even contacted us. Before going he said us to live in his property and take care. We made 2 store house in that land in 1992 and since then we were residing there. In between the time we made several attempts to contact him but never got his contact information. After 16 years we thought he may have died in an accident that why he is not coming back. Then we paid the rest amount and got the property papers from the land owner and then we mutated the property in our name. 1)Now he has came back and claiming the land and house too. Legally can he claim land and house both? 2)Can we take adverse possession in our defence now?
Apparently you and your family are in wrong footings. The ownership issue needs to be settled immediately for your own interests. You have stated that the original owner handed over the property documents to your family upon receipt of balance amount of money from you and you have invested money on the same property for your own interest assuming that the original owner might have left the world.
Be that as it may , if you so desire, you can contact me through lawRato for suitable legal way out .

MY OPINION THAT i have follow the story ,very interesting, the property which has under your custody with the full protection, you have paid the rest outstanding and you have the legitimate claim on the said property after the mutation, so you have absolute defense on adverse possession but you should take legal steps immediately.
You are not only adverse possession but also the owner as per mutation. You paid part of the price of property. So you have a right over it.
You can file a ownership suit in court to officially declare that you are the owner. That's all. Nothing more is needed.
Regards.
