how to get the share of property being a son

Father and me bought the land on 1990 June on mother name. I am Hindu Having 2 brother .Father me & one brother built 3story bunglo in Pune the youngest brother was study at that time and has not contributor to the said property.up to father alive all it's ok after death of my father. Now mother wants to give all the property to only youngest brother please suggest me what to do in this regard my age is 52 yrs I have invested all my hard money to built this house please help me to guide how we can get the justice.

SInce the said property is in your mother's name, you and both your brothers have equal shares in the property. You could have asked for partition if it was an ancestral property of your father but unfortunately this property will be considered as self acquired property of your mother. All i advise you is that dont vacate the premises. Dont let anyone else take the possession of the place acquired by you. if your mother dies without a will you will automatically get your share and even if she dies making a will favouring your youngest brother than you and your other brother can object in the High Court when the will is probated.

It is upon the interest of your mother. As she is the owner of the property now. She has exclusive rights to transfer the property in the name of your brother. But if she passes away intestate the property will be equally divided among three brothers. Also please make your mother understand through various family mediators to equally distribute or apportion the property as applicable.
