How to get refund from builder for delay and possession of flat ?

I have booked flat november2015.and hand over time is may 2017. But up to date it has only two roof construct.when i refund money back with interest then they denay.in our aggrement no refund mentioned.but builder donot work of flat progress.its completion uncertain.so i wan to cancel flat. Can i refund money.???

The best way is to file one consumer complain case before the proper forum on the basis of da agreement praying for refund compensation and other cost for delay and deficiency in service in the part of the developer

Yes you can ask for refund of money and also your possession of flat in consumer court but flat value is required and you can ask for compensation along with interest. It depends upon how much money you have paid.

Yes, but I am curious to know 1 thing that when the agreement for booking of flat was made have you not read the terms and conditions of the agreement?If you have read it then where is the condition for refund of money for non delivery of flat within the stipulated time?Anyways you can file a suit a suit before the civil judge for recovery of money. Thanks.
