How to divide property when the property is in fathers name

sir hum father se jamin me hissa lena chahte hai matlab batwara karna chahte hai jameen father ke naam se registered hai lekin father batwara nahi karna chahte hai bolte hai mere death ke baad batwara hoga kya court batwara karegi father ke margi ke khilaf
अगर पिता की सम्पत्ति अपलोग के दादा-परदादा की सम्पत्ति है तो आप कोर्ट से बँटवारा के लिए केस फ़ाईल कर सकते हैं। कोर्ट उनकी इच्छा के विरूध भी बँटवारा कर सकता है। लेकिन यदि सम्पत्ति पिता की अपनी बनाई हुई है तो फिर पिता की इच्छा सर्वोपरी होगी।
