How to claim money back once paid for registration of sale deed

My father gave 3lakhs to a person out of 4lakhs and that person executed a register sale deed of plot in 2009 which states that to pay remaining 1 lakh with in 3 years and he wil register a plot.now what can I do b/c my local layer told time of document is over.my father name is coming in mutation.can I recover money of 3 lakhs with interest or can I claim for plot by paying remaining 1lakh.

Hi You have not made your case very clear to us, for suggesting you advice. Once you say paid 3 lakhs and sale deed is registered in 2009, and balance to pay 1L by/in 3 years. Now, their is no question for registration again. The seller now even can't claim that amount of Rs.1L because it's more than three years from the date of due i.e., 2012. Even now it's not late for better solution, you both have to sit together and sought out it buy selling it to third party & share in ratio of 3/4&1/4.

You can file case for getting registered document of sale deed by paying remaining amount or you can seek earnest money with interest and you will get relief on the basis of terms and conditions of said document
