Father's brother took more than his share now filled a case again him

Brother of my father cleverly built house more than what his share is authorized and my remaining share is left blank land by me. He filed a PIL of public way saying me to be the encroacher though it is my own land. What could be the possible outcomes of this case. I am hindu.
