Can one of the plaintiffs be converted as defendant

We are jointly plaintiffs and already got preliminary decree (jointly 1/4 th share) in the year 2013.......commissioner appointment is pending in lower court.in the mean time one plaintiff(my sister) wants to converted as dependent and wants separate share and possession....... Is it possibe now.....pls help.

since the preliminary decree is passed and the appointment of commissioner is pending then your sister can file a new suit claiming her right of seperate share and possession.....ur sister needs to start a new suit for better course of action

MY OPINION THAT if your fellow sister can do all these happening after preliminary decree from the lower court, and which is completely opposite the actual findings, you can just now protect your self and as well as you have definitely get parallel legal action /actions at competent court / courts.

yes it is possible. If she file counter Claim. then she became a Plaintiff and all the previous Plaintiffs became Defendant. you should submit Written Objection against her Petition. Please follow the advise of your Conducting Ld Lawyer, he will properly guide you.
