CAN MADE A GIFT THROUGH GPA BUT NOT MENTIONED THE DO GIFT IN GPA

Dear Sir/Madam, My uncle has got property through registered gift deed from his mother. Thereafter the Uncle has given general power of attorney to do act on behalf of him for disposal of the said property. Now the Uncle wants to execute the Gift the said property to his sister but not mentioned the Gift specifically in the said GPA. My uncle has to be do the same through his GPA holder (mother) because of my uncle is out of country. whose presence is necessary before sub registrar office?

Whether your uncle himself wants to execute gift deed for the property ? if the GPA that he executed does not give the power to your mother to execute a gift deed then your mother legally cannot sign for a gift deed.

When a power of attorney GPA given he has to give recitals how he got property in his name and if GPA is registered it's valid if not it has no value so get GPA from foreign by embossing there and later get registered.
