Can I reply to a summon after the expiry of 30 days

, actually I have received civil suit summons on 23rd of may2016 ,where it is stated that I have to submitted answer within 30 days of receiving of summons ,,but I have not submitted any reply till days and its 1 month past and date of hearing of case is 14th of july2016.... Please advice should I submitted answer now and it will be a problem for me or not

According to CPC your are required to file your Written Statement(answer) within 30 days from the date of service, but not later than 90 days.
Now you can file your WS with an application under order 8(1) CPC.

You have not mentioned in which court your matter is pending. If it is in Delhi here in Courts summer vacation is going on so your period of one month would be over only on the day of reopening of the court. You should appear on the dater of hearing and try to file reply on reopening of the court. If any other state is there you can tell i shall advise you accordingly.

If the judge is considerate he will grant you an opportunity to submit the reply on the date of hearing, which they usually do.However, if its a summary suit and the judge thinks that you are wasting the time of court, he might impose cost on you.

Sir you can submit your written statement with a delay application with bonafide reasons and the reasons for this delay.
In worst scenario there will be a certain cost imposed on you if the courts find that the reasons were not bonafide, and your w.s will be take on record.
