Can I claim property by filing a suit against my father

15-Feb-2023 (In Civil Law)
Sir we belong to Hindu family. My father had an agri land of 10 acres. He got the land by partition between his brother and sister on 2000. That whole property is bought by their father ie, my grandfather by his own earning and documented . . My father gave all the property by settlement to my sister aged 45 married. On that property 3.5 acres have no parent document but resurveyed under my father's name and patta , "A" register extract are in my father's name. My father is still alive and possession also by my father and mother. Can I claim by SUIT against my father. Is it possible ? Please guide me good way

Sorry, you cannot claim right over the property. Once the property had partitioned between the legal heir then it will be called as separate property of the person for whom it was allotted. Your father have all the right to settle the property to whomsoever and it cannot be questioned.

According to you the property is an ancestral property. If so ,you can file a suit against your father for your share but you have to proove that is your ancestral property which has been resurveyed and given patta on your father's name since the said property did not have parent document .
