As per hindu succession act Daughters and sons have got equal rights over the self acquired property of your father. After your father's demise the property shall be mutated in the name of all the legal heirs.

Yes you can claim your share in the property in view of the amended provision of the Hindu Succession Act. For that you need to file civil suit for partition in the civil court. Since the partition has taken place in your family before 2005, you can file the civil suit before the Civil Judge (Senior Division) or Civil Judge (Junior Division) depending upon the valuation of the plaint.

Dear madam,First of all you have not mentioned, whether the property is self acquired property of your father or it is ancestral property of your father ? Similarly you have not mentioned among which members of the family, the partition took place and how much share is in your mother's name ? If the property is ancestral (forefather's), then you have no right. If it is self acquired property of your father And the mother is enjoying her share , then you have got share in it.
