Can court fees be paid during the pendency of a case


19-Apr-2023 (In Civil Law)
in a property case filed by my lawyer in lower court ( munsif ) and paid court fees of only 1 hundred Rs. the valuation of the property is 12 lakhs. I consulted another lawyer who told me that the case may suffer due to nonpayment of proper court fees. Is there any way to amend -- I don't want to file it fresh as in that case I may lose the benefit of stay order I have got.

yes court fees could be paid in the inbetween stage.if the fees paid at the time of filling is inadeqeate rs 100 in case of 12 lakh property is a himalayan blunder.i could not understand if you had declared the actual valuation or taken undue advantages

The pecuniary jurisdiction of the Court depends on the value of the suit. What suit you had filed I do not know.
If the suit value is higher then the suit need to be filed in the Sub-Judge court. In such case your case will suffer on the ground of jurisdiction.
Better withdraw the suit with the permission to file afresh to the upper forum. The lower court have no right to transfer the case to the upper forum.

necessary court fees can be filed/paid during the pendency of the suit.the suit will not suffer due to non payment of necessary court fees for the filing.the technical defects for filing of the suit do not suffer for merit of the suit.
