Brothers right in fathers ancestral property that he wants to give me

I am from hindu family. I have one brother and he was living with my grand mother ( mother side). As per family understanding, it was agreed property of grand mother to my brother ( she dont have sons) & my father property to me. My father having one house , one acre land ( both purchased by own) , one acre (his mother given). My brother has interst on my father property.My father wanted to give me as gift to me. Since those are not ancestral propery, please tell me the legal opinion if he goes to court .

your brother does not have any right in your father's property because one acre and one house are your fathers self acquired n another acre does not cum under ancestral property as it was given by his mother .ur brother does not have any right to go before the court.

Dear Client you did not mention about the way the property that was given by your grand mother, i.e., by way of will gift or natural succession and also you must mention that your father mother is alive or not. Self acquired property will be given by your father at his own will i.e., he may convey the same by way of gift to you. You must also state that your brother was adopted by your grand mother or not. If not he is entitled to get portion of ancestral property of your father i.e., he got from his mother. If your father`s mother`s self acquired property and if she bequeathed the same by way of will or gift it amounts to self acquired property of your father and then the same may also by conveyed by way of his own will i.e., by way of gift, will., etc., then your brother will not agitate his right.
